Understanding Provisional Filing

What is a Provisional Patent Application?

In common business language, people often use the term “provisional patent” for an application filed with a provisional specification.

Legally, the Indian Patent Office does not grant a separate “provisional patent certificate” that provides permanent patent protection. Instead, the applicant files Form 1 (Application for Grant of Patent), Form 2 (Provisional Specification), and other applicable documents with the prescribed fee.

The provisional specification describes the invention and is filed before the complete specification. Every provisional or complete specification is made in Form 2. A provisional filing is part of the patent application process — it does not by itself result in a granted patent.

What Should a Provisional Specification Contain?

Under Section 10 of the Patents Act, every specification, whether provisional or complete, must describe the invention and begin with a title sufficiently indicating the subject matter. Drawings may be supplied where appropriate.

Claims are required in a complete specification (Section 10). A provisional specification is intended primarily to provide a description of the invention and establish the filing date. It should not be treated as merely a short summary or informal concept note.

Identify the Invention

Document technical problem, existing technology, proposed solution, components, process steps, features, working principle, variations and advantages.

Prior-Art Search & Patentability

Search existing patents and publications. Assess novelty, inventive step, industrial applicability, patentable subject matter and statutory exclusions.

Prepare & File Form 1 + Form 2

Draft provisional specification with adequate technical disclosure. File Form 1, Form 2 and other applicable forms with the prescribed government fee.

Develop & File Complete Spec

Within 12 months: continue development, prepare complete specification with claims, and file. No further extension after the 12-month period expires.

After Complete Specification

Filing the complete specification does not mean a patent has been granted. The application continues through publication, request for examination (Form 18/18A), examination, response, hearing (if required) and consideration for grant.

If Complete Spec Not Filed

If the complete specification is not filed within the prescribed 12-month period, the patent application is treated as abandoned under Section 9, subject to the provisions of the Act. Deadline management is critical.

New Matter & Priority

Development can continue after provisional filing. New subject matter does not automatically receive the same priority date. Priority of later claims depends on what was fairly based on the matter disclosed in the earlier specification (Section 11).
